Canada’s Education System

Education is within provincial jurisdiction and the curriculum is overseen by the province. There is no ministry or department of education at the federal level, provincial governments have exclusive responsibility for all levels of education, although the federal government has delegate the responsibility to the territorial and provincial governments, it cooperate with the provinces to deliver postsecondary programs.

STUDY PERMIT APPLICATION

A Study Permit is a document issued by Citizenship and Immigration Canada that allows a foreign individual to study in Canada for a limited time. Most international students will require a Study Permit to study in Canada.

TO BE ELIGIBLE TO STUDY IN CANADA

You must have been accepted by a designated learning institution in Canada.
You must prove that you have enough money to pay for your:
- tuition fees
- living expenses for yourself and any family members who come with you to Canada and
- return transportation for yourself and any family members who come with you to Canada.
You must be a law-abiding citizen with no criminal record and not be a risk to the security of Canada. You may have to provide a police certificate.
You must be in good health and willing to complete a medical examination, if necessary.
You must satisfy an immigration officer that you will leave Canada at the end of your authorized stay.

OBTAINING A STUDY PERMIT:

If you are a prospective student, you should first decide what sort of program you wish to pursue, and determine what institution is the best fit for your field of study.
Once one or more places of study have been pinpointed, you should learn what you must do to get admission.
Once admission to one or more schools has been obtained, you can begin applying for a study permit.
When applying for a study permit, it is important to remember that CIC may require you to under go medical examinations and provide Police Clearance Certificates.
If you wish to study in Montreal or another city in the Province of Quebec, you will also require approval from immigration authorities of the Government of Quebec.

STUDY PERMIT EXTENSION

Study Permit Renewal

You must apply before the expiration of your study permit if you would like to continue studying in Canada. Schools recommend you apply at least three months before the expiry of your status, to allow for processing time. If you apply for extension, you must stay in Canada and meet the conditions of your original study permit (i.e.: you cannot quit school and begin working).

Expired Study Permits

If you study permit expires and you have not applied for an extension, you must stop studying and/or working immediately, as you will be considered out-of-status.

If you fall out-of-status, you must apply for a restoration of status. You will have 90 days from the day your study permit expires to apply for this restoration. This application can only be done inside Canada and you will need to remain in the country until a decision is made on your application for restoration of status. The restoration process can take several months and there are no guarantees that your application for a new study permit will be successful.

POST-GRADUATION WORK PERMIT

The PGWPP allows students who have graduated from a participating Canadian post-secondary institution to gain valuable Canadian work experience. Skilled Canadian work experience gained through the PGWPP helps graduates qualify for permanent residence in Canada through Express Entry.

A work permit under the PGWPP may be issued for the length of the study program, up to a maximum of three years. A post-graduation work permit cannot be valid for longer than the student’s study program, and the study program must be a minimum of eight months in length. For example, if you graduate from a four-year degree program, you could be eligible for a three-year work permit if you meet the criteria. If you graduate from an eight-month certificate program, you would be eligible for a work permit that is valid for no more than eight months.

To be eligible for a Post-Graduation Work Permit, international students must:

have studied full-time for the eight months preceding the completion of their program (please see note below) and must have graduated from:
- a public post-secondary educational institution (university, college, or CEGEP); or
- a private post-secondary educational institution that operates under the same rules and regulations as public institutions, and receives at least 50 per cent of its financing for operations from government grants; or
- a Canadian private educational institution authorized by provincial or territorial statute to confer degrees;
apply for a work permit within 90 days of receiving written confirmation from their academic institution that they have met the requirements of their program;
have completed and passed the program of study and received written notification that they are eligible to obtain their degree, diploma, or certificate; and
have a valid study permit when applying for the work permit.

POST-GRADUATION WORK PERMIT

To be eligible for a Post-Graduation Work Permit, international students must:

have studied full-time for the eight months preceding the completion of their program (please see note below) and must have graduated from:
- a public post-secondary educational institution (university, college, or CEGEP); or
- a private post-secondary educational institution that operates under the same rules and regulations as public institutions, and receives at least 50 per cent of its financing for operations from government grants; or
- a Canadian private educational institution authorized by provincial or territorial statute to confer degrees;
apply for a work permit within 90 days of receiving written confirmation from their academic institution that they have met the requirements of their program;
have completed and passed the program of study and received written notification that they are eligible to obtain their degree, diploma, or certificate; and
have a valid study permit when applying for the work permit.

WORK AUTHORIZATION

Study permit holders in Canada may gain work experience by working off campus while completing their studies.

As of June 1, 2014, you may qualify to work off campus without a work permit. If you qualify, your study permit will allow you to:

work up to 20 hours per week during regular academic sessions and
work full-time during scheduled breaks, such as the winter and summer holidays or spring break.

To qualify, you must:

have a valid study permit,
be a full-time student,
be enrolled at a designated learning institution at the post-secondary level or, in Quebec, a vocational program at the secondary level, and
be studying in an academic, vocational or professional training program that leads to a degree, diploma or certificate that is at least six months in duration.

You must stop working on the day you no longer meet the above eligibility requirements (e.g., if you are no longer a full-time student during an academic session.)
